Default FXD Transfer So. Dak. State Sales Tax Question

Hi, I purchased an 05 FXD in Oregon in February of 2005 for $12,150. They have no sales tax in Oregon which was great. Now that I moved back to South Dakota and tried to get my license plate transferred, they want the sales tax (which amounts to almost $400) that I didn't have to pay in Oregon. Is there anyway to legally avoid this? Why should South Dakota get the sales tax since I didn't buy the bike here? I feel I've already contributed to the tax system by paying state income tax in the state of Oregon for many years while being gainfully employed there. Any information that can be provided would be appreciated. Thanks, Jody

That does seem unfair. What if you had paid sales tax for it in Oregon, would they charge it again?

It's a tax. It happens in most places. Usually to those 'other' people, so nobody cares. If you live in a no tax state... stay there and hope for the best, otherwise hang on for a few years.

Lots of states do this and you're right, it's a giant rip-off. don't really know anyway around it.

Sorry, you're SOL... VA is the same way....doesn't matter where you buy the vehicle....where your registering it determines the taxes.

If you're a resident of one state and go out of state to make a purchase, you usually are required to pay sales tax in the state of residence. If you were a resident of Oregon, bought the bike, moved to S.Dakota, then changed residence, I would think, you shouldn't be required to pay the sales tax.

I work for a place that sells trailers. We have 4 locations here in MN and one in ND. We sell a lot to SD. If the buyer is out of state we do not charge sales tax on the trailer they pay it to the state they register it in. I would imagine it would be the same with any "vehicle".

yeah I bought my bike in Tennessee and didn't pay sales tax. but once I went to register it in PA (state of residence) i knew I had to pay the 6% sales tax and the 1% county sales tax..total bill ended up being 1599.50

Death and Taxes, can't avoid either one.

In 1981 I was transferred from Washington to California. I had a 76 Ford F250 that I bought new in Washington and paid the taxes on. When I registered it in California I got to pay the taxes again. In 1987, I transferred back to Washington. Still had the truck. Guess what, I got to pay Washington taxes again. Both states called it an excise tax and it was 2% of the current value of the vehicle.

You may just want to go over the head of the person you are talking too. I mo0ved to washington years ago from Calif. and the clerk tried to charge me sales tax on the pickup I moved up with. All I had to do was ask for a supervisor and when the supervisor came over she informed the clerk that I did not have to pay Sales tax because I was just moving into the state. If I had been a resident and went out of state to purchase a vehicle I would have been required to pay sales tax. The "CLERK" stated that she always charged tax. (nobody had questioined her) I had the same thing happen when I moved to Calif from Utah and they wanted to charge sales tax. I questioned it, They "RED TAGGED" my registration and the state issued my tags without charging me tax after review.
