Habitual offender kills cop on his motorcycle...

I hope they finally lock this bastard up for good...the original story last week stated this Orta has been arrested 17 times since 2000... ...this cat was still out running around. Sorry, this one just struck a nerve with me.

Arrest record:

Orta's record, according to the St. Joseph County Police:
3-28-2000: Theft, Criminal Mischief (Felony) when he was 17 years old
3-01-2001: Warrant for the above charges
6-27-2001: Warrant for the above charges again
7-01-2002: Minor consuming, Battery, Resisting Arrest, Visiting a Common Nuisance, False Informing
9-17-2002: Warrant for above charges
2-26-2003: Vehicle Assault, Resisting Arrest by Flight, Warrant for failure to appear
5-07-2003: Probate Attachment (Child Support)
6-13-2003: Probate Attachment (Weekend Sentence)
6-20-2003: Probate Attachment (Weekend Sentence)
6-30-2008: Warrant for failure to appear
11-16-2003: Warrant for failure to appear

My question...does anyone think the prosecution/judges have some responsibility here?

Dear GOD ! What would possess a person to just back up and run over someone !!? There is no question in my mind, the driver deserves a swift execution.

When will these stories be enough to deter people from gettin' sh!tfaced and driving a vehicle? My wife and I have been hit twice by drunks. The first one just knocked us over and we were lucky enough to not be injured and have a cop roll up on it within 20 seconds!!! He was behind us for miles and I didn't know. The second one almost killed us. We are both bolted, stitched and stapled back together.

The two A$$HOLES that hit us:
*****Both individuals had criminal records
*****Both were drunk
*****Both were driving illegally (no license or license suspended)
*****Both tried to escape after hitting us and both were caught by police officers
*****Neither had any kind of insurance except their own personal "government parachute"
*****One still owes me $500 for my deductible (for the record...a 39 YO black male from Georgia)
*****One is serving 8 years in a Florida State Correctional Facility, they are "correcting" him (for the record...a 51 YO Mexican male who has been here illegally since at least 1987 by his criminal record!)


The indidual that killed the man after getting out of his vehicle and looking at him should be convicted of murder and put to death. It appears that he willfully ran him over again with intent to kill him and get away. I would like to respectfully volunteer to run him over with his own vehicle as the death sentence.

Robert Orta, Sr., of South Bend, feels his brother, Alexander Orta, should not be charged with murder for driving over Roseland Town Marshal Craig Toner while fleeing the scene of a crash. Robert is seen here Wednesday leaving the St. Joseph County Courthouse following his brother's arraignment.

Meanwhile, the brother of Alexander Orta, the man accused of his murder, apologized to the victim’s family on behalf of his own and said Orta was an American citizen raised in this country and not an illegal immigrant

What a terrible story. Something is definitely wrong with the system when someone with that long of a record is still free to move around at his will.

Watching it all week on the local news is has been like one moment...it pulls at your heart strings for officer and family and the next moment they bring up Orta's face and blood pressure rises rapidly....just have to walk away at times and reset yourself.

They say Orta got out of his car and looked at Toner and his motorcycle, then got back in his car and drove away, running over Toner.

An autopsy Monday showed Toner died from massive chest injuries that likely came from being run over.
I would hope that gets upgraded to murder - DUI Causing a Death would be if he killed him when he hit him - when he gets back in the car and runs over him AND that's the cause of death, that's a murder around here and he would be charged and convicted accordingly. Given his record, one might even try to prove that he knew the officer and that's why he killed him and possibly even get him eligible for the death penalty.
