Lets not forget that an arrest is not an admission of guilt, its the systems way of slowing down the parties who they think are involved.

Once the lawyers are invoked the process begins. LEO's are doing their job and the system will do its job.

Shame on the Mongols for cooperating with the History channels "Gangland" piece.

I'm not a big fan of the RICO laws because of the power it gives the government to charge people with crimes just because they hang around with people who might be involved in criminal activity. I believe individuals make a personal choice when it comes to committing a crime. The organization itself does not have a brain and cannot make such a choice, so just being a member does not mean one is a criminal.

That said, it sounds like they did some heavy duty undercover work here and have built some serious evidence against these individuals. If that's the case, more power to them. All I can say is WOW! those are some ballsy undercover agents.

Wrong link. The story in the link you provided was about criminal members of a criminal organization getting busted after an extensive undercover operation. Nothing in there about anyone getting busted for guilt by association. I was looking for something that said "Billy Bob Gonzales, a friend of one of the criminal gang members, was arrested..."

Why would a person join an organized gang of criminals if that person was not a criminal? Participating with others who are committing a crime is a crime.

For example, you and a friend are going to go out for a few beers. He tells you he needs to stop at a bank and get some money. He tells you he doesn't have an account, but, uses a gun as a withdrawal slip. The two of you walk into a bank, he robs the bank while you stand their adjusting your assless chaps. Guess what - You just participated in robbing a bank, and you are a criminal.

No one joined the Mongols for their great health plan, 401K or the awesome free arts & crafts seminars.

I'll have to agree with you on that one intempestivus Just joking, I know what you meant.
Nobody joining an organization like the Mongols or HA has any illusions about it being just a social club made up of motorcycle enthusiasts. In fact, the motorcycle for those guys is nothing more than a symbol, much the same as their cuts, tattoos and general appearance. It creates an image of intimidation, which is exactly their point.
Therefore any member should be collectively guilty - probably won't happen but that's my opinion.
It's a bit hypocritical on the one hand for them to crow about the collective retribution that will be metted out if you disrespect them and on the other hand cry that they can't be collectively punished for the transgressions of individual members.
The interesting issue will be if the government can really win in branding them a criminal organization.
And yes, I think those undercover guys were incredibly balsy - wonder when the film will come out
