Not all states work the same way on that. In some States (Missouri being one that I know of), the title is sent to the buying at the time of registration. But it will have the lien holder listed on it.
I have the title to my bike, with the lien holder listed on it. I can not legally sell it without a lien release form once the note is payed off.

how would the seller have the title if there is a lien on it? as lax as alabama is on titles the lienholder still gets the title from the state not the owner so an owner cannot sell with out a cleared title.

I totally agree with all the guys comments. They are all on the money. Believe me, I was burnt one time on a deal just like yours. Listen to these guys, they know what they're talking about!!!

Yes, they just started doing it this way about 3 or 4 years ago.

thanks a million for all of the help here fellas! i said **** it and went and bought a brand new one for the same price.i walked in and rode it out in an hour.having said that, i did learn in this processthat if i am ever in this situation again to go to the dealer and have them do a "dealer assist". that makes it painless and flawless.

The Sporty looks fine.
I bought an 05 RKC last Sept from a private seller. EagleMark had a lien on it.
My credit union made a check out to Eaglemark and another to cover the owners "profit".
I took the bike home after handing the guy the checks.
The first thing you got to do is get it insured to protect against theft or fire.
Then you got to wait almost a month for EagleMark to take their time transfering the title.
I do love the bike, but that was a process I don't wish to go through again.
Althoughyou didn't have to go through that, most times you save big bucks going through private seller.
