'nuther question about stage 1

I was reading SA315B's thread about race tuners (https://www.hdforums.com/m_3137724/tm.htm) and it brings up a question I've been wondering about regarding the stage 1 mod. If HD is handcuffed by the EPA how can they turn around and alter the set up on your bike? Does it make sense to take it somewhere else to do the job (if not doing it yourself)? Does HD have you sign a "release" form if you ask them to change all their legal settings? I'm in California and some of the EFI tuners aren't even sold here (illegal).
