Thats a damned shame officers make that kind of money, I make twice that or better most years and Im just a carpenter. Even worse, you made it sound like it was good pay...

Most places, that Officer would be prohibited from purchasing any items he was involved in the seizure of. And quite frankly, I doubt you are gonna find an Officer that is willing to (at the least), risk a 45k a year job for a 15k bike.

What happens when an officer sees your bike and decides he wants it? Where is the proof you were going 30 mph over?

The Florida Contraband Forfeiture Act allows the seizure of property involved in criminal activity. The mere seizure of the property is the first step of the process. The person from whom the property is seized must be notified of an "adversarial hearing" within 10 days of the seizure. The adversarial hearing is a civil hearing before a judge. The facts of the case are presented at which time a judge determines if the forfeiture of the property is warranted. In many cases, agencies choose not to pursue the forfeiture processbecause it is not economically feasible. Agencies must consider if there is a lien on the property andwhat the cost will be to satisfy the lien.Considerations also include the cost of litigation.The intention of this post is not to weigh the pros and cons of the proposed legislation, it is to merely explain theforfeiture process.

I am sure there are. But not near in the frequency that some would like to believe.
I think you are all missing the "Subject to forfeiture" part of this proposed legislation. The LEOs don't make the determination if the bike is forfeited. A JUDGE does that.
Of course, it is conceivable that a Judge could want a bike, and that same Judge has a son that is a Police Officer, and that Officer's Commanding Officer was on the grassy knoll.........you get the point.

I think crushing the vehicle would be more fair and less controversial than selling it at auction. At least theres noincentive toto take your vehicle unjustly for profit. Not that I have changed my views on the whole thing. We will have to thank ourselves if this bill gets passed we vote um in.
