It is NOT an offense if you do not have a cetificate or sticker
However, having the sticker where the officer can see it removes probable cause for the stop.

The helmet exemption sticker is an option that tells the officer you have met at least one of the required exemptions for riding without a helmet. If you do not have the sticker displayed on your license plate, you would need to have physical (hardcopy) proofof having at least $10,000 worth of medical coverage (i.e., insurance card such as Aetna, HMO Blue, etc.) or proof of completion of an approved Motorcycle Training Course (here in Texas the certificate is called an MSB-8) on your person. One other thing worth mentioning here; If you or your passenger choose to wear a helmet, it must be DOT compliant. The officer can write you a ticket if it is not.I teachMSF classes here in Texas so I hope you and your passenger choose to wear a helmet. Have a safe trip.

I would not count on an officer being unable to articulate probable cause to stop you.

.......Plus pay the state 5.00 for a certificate....
Wrong. You do not have to buy the certificate, that is optional at the discretion of the biker.
It is a requirement and they can write a ticket at their discretion. Trust me
It is NOT a requirement, but they can pull you over to check for rider certificate OR insurance proof if you do not have it. If anyone wrote you up with either of those 2 provisions covered, you got screwed. The $5 sticker is absolutely optional, but the only way to not be pulled over for inspection.

I did not state it keep you from getting stopped, and probable cause really only come into play in the court room. I am not an idiot and woud not argue probable cause on the road side just to make things worse.

The sticker is a requirement to for sure avoid a ticket, the officer does not have to except proof of coverage or training. I had my wife ask about it at work(DPS Training Academy) after my West Texas stop. It is kinda like if ya got insurance but can't find the card you get a ticket then it gets dismissed once you show the court you had the coverage needed

The stickers are serialized and good for 3 years.

Actually yes they DO have to accept proof of rider training or insurance. It is not training AND insurance, it is OR. There may be a cop being a d!ck giving you a ticket, but as you say it WILL be dismissed on proof of either prereq. And at that point the weenie eater should have a formal complaint filed by the motorist they illegally targeted. Repeated until the cop either learned and stopped, or was reassigned (or fired). It is positively, absolutely true that taking the riders course does exempt you. And pure BS if any law enforcement official took it upon themselves to ignore said exemption. The sticker was just an idiotic loophole put is just so cops could make bogus stops. But unless something else was wrong, ANY ticket given when proof was given is wrongful prosecution. And anyone doing that should NEVER have a badge.
