my trade in was not paid off for 2 wks and only then because i called and harassed them over it daily after a wk 1/2 . so get on the phone hot and heavy , be a real "B" over it if you have to............

Sounds like they may have mistaken the deal as a Consignment situation. Check your paperwork and verify. Good luck.

The situation is hopefully resolved but will not know for certain until the end of next week when I follow-up with my bank and confirm the bike has indeed been paid off. This seems to be a situation of sloppy paperwork and business practice. When I traded in my bike, I did not take the payoff with me, but they had my credit report which showed a balance of some $6500. As a part of the transaction they agreed to pay my bike off and the trade in allowance was $6700. The understanding was that I would reimburse them any amount over $6700. The following week the sales manager called and said I owed them $66 so I put a check in the mail to them believing that my bike had already been paid off. Three weeks later, I get a call from the sales manager saying that they never received my check and now they need $120 or so to pay it off. To say the least I was upset. Why three weeks later and why hadn't my bike been paid off. I initially refused to pay any additional amount over the $66 but then forked over my debit card/credit card number the money from which comes directly out of my checking account, expressing my extreme displeasure to the sales manager. He said he would even pay any difference from what I was paying to the new payoff figure. Fine, I said and thanked him. Then I get a notice from my bank saying they had just deducted $141 from my checking account for the deliquent May payment. So I called the Sales Manager back, informed him of the addtional money paid and assumed we were done, but if not, to please contact me. I had not heard another word until yesterday when I got another notice of delinquent payment in the mail from my bank.

So I go over there today and the owner is laying all the blame on me. That his sales manager never communicated any of this to him and he had no excuse for letting the matter sit this long except to say that he thought his sales manager was handling it. I asked him why he didn't just use my debit card number to obtain any additional payoff amount when it was given by me to his sales manager over the phone. Again, he said he never got that information. He, the owner, never bothered to contact me personally about this, again because of his sales manager was supposed to be handling it. Interestingly, his sales manager did not even have the decency or courtesy to come out and speak with me the whole hour I was there.

Long story short. I paid $22 for the current payoff over $6700 in order to get the matter resolved and will have to take the ding on my credit because this is supposedly all my fault. Now, I've traded in numerous cars over the years, and have never had a car dealership sit around waiting for payoff info.from me when they had my credit report and my account number. They've always gone straight to the bank, obtained the payoff and made the payoff, so I am at a complete loss, why Big Dog Motorcycles of Atlanta, now owned by Hog Heaven Motorcycles and owned by Tom McDaniel, seems incable of obtaining that information for themselves and acting professionally and accordingly. Or why the Sales Manager there, Steve Breeze, also seemed likewise incapable. I will certainly be making an entry onto Stealer-Dealer once I know that my bike is paid off. I point blank told Tom McDaniel that I would do everything I could to ensure that no one I knew would do business with them. This has turned out to be an absolutely terrible experience. Very unprofessional.

I know you're gonna let us know what happens. I'd also suggest the 1-800 State Attorney General's Fraud Hot Line. And suggest moving super fast on all of this!!!!!!!!!!!!!!!!!!! That dealer behavior could be a prelude to their bankruptcy or other actions and the moment such actions start all parties standing in line risk losing their stakes in the mess.

Certainly not an attempt to "dig" any deeper into your life, but where was your husband during all this? I'd break my foot off in that dealers azz and deal with the ramifications later if it were my little peach having to put up with this.

Tom McDaniel is quite tall and has a very big chip on his shoulder. I got the distinct impression that he has dealt with one two many scumbags and therefore everyone he meets is out to try to screw him over. I most distinctly was not. Not the way I operate. I merely wanted my bike paid off as agreed. All this ridiculous trouble and delay over what amounted to $164 and the guy has had my credit/debit card number since early June! [:@][:@][:@] Oh, and I had even faxed them over a copy of my bank printout from where I had to stop payment on the check written to them for the $66 they initially requested.

Our dynamic is that I handle the finances and deal with any problems associated with same. He's a wonderful man, but he doesn't fight any battles for me. I found out from a very early age that the only person I can TRULY count on is myself and NO ONE would fight any battles for me.
