Let's take that timid 45 mph subject "rider" in this thread. Two lane highway, one lane in each direction. Speed limit is 65 and douche rider is at 45. BTW, you can also get stubbed for riding too fast for conditions. The speed limit might be 70 but 35 might be the maximum safe speed due to snow, ice, fog, rain.
The maximum safe speed when traffic is stopped is 0.You rearend a stopped vehicle at 30, you will get stubbed for driving too fast even though the limit is 65.

Yeah in another post I stated that the law you quoted gives much discretion to the LEO.


If you are an LEO, which I think so, you know that each state and jurisdiction is different. In the several jurisdictions I have worked, the first scenario given would be pretty shaky as far as prosecution. I don't know your jurisdiction so I can't say but I do know the one's I've worked and you would have a hard time justifying a ticket in that scenario for a multitude of reasons. In my opinion it may be easier to cite someone in your jurisdiction for the scenario given but I'm would be very surprised if successfully prosecuting it would be as easy as you say it would. Not trying to be argumentative, but I do have a slightly different opinion.


And yes I know all about the maximum speed limits and that most posted speed limits are under "ideal" conditions and that you can cite someone for "speed greater than safe" or something similar when conditions are not "ideal" even though they are going under the posted limit.


As far as your last scenario I guess that would be somewhat applicable in any jurisdiction but in most jurisdictions (at least the ones I've worked) you could use state driving laws to more appropriately cite the driver for a rear end accident if you so decided to.

EDIT, this thread is so old they could have walked there and back 17 times and drank 9 kegs of beer all while telling the slow rider how great he was. EDIT again. Figures it has to be someone between BARSTOW and NEEDLES that bumped this OLD thread

I had a friend like that......trailered his bike 1000 miles for a visit. Up in the AM to ride, 5 minutes into it, I see him turning around. He went to back to the house. Said there was something wrong with the bike, and asked me to ride it. I rode the stuffing out of it, nothing wrong but the rider, he was afraid of it. He sold it a month later

I won’t ride with anyone but will meet anyone at a pre determined destination. I simply tell them I’ll see you when I get there and off I go on my own. I suggest you tell him the same thing.
