Don`t worry about it, this is not an uncommon occurrence on a dry sump system with an oil tank that is mounted higher than the engine.

The oil simply leaks past the check valve in the oil pump, often there is nothing wrong, just that possibly a spec of debris just happened to get lodged between the ball and the seat, preventing the check valve from fully closing.

The oil is down in the bottom of the crankcase, and when you start the engine, the scavenge system will attempt to return it to the tank. It may blow a fair amount of it out the breather, so don`t panic if you see oil slobbering out of the air filter area.

I would remove the a/c before starting and have something handy to catch the oil when it blows out the crankcase breather, avoid a big mess.

Thanks again for all the help. I put a little oil in the oil pan and started it up, i left the oil dipstick out so i could make sure it was returning oil, right after it started the oil return was sending oil back. let it idle for a bit then shut it down, waited a while and checked the oil and it was just over full ( from the little i added before i started it.) All is good!!

Wow learned something new...

"Whatever you do dont remove the plug at the bottom of the crank case! "

Soft02, I don't get it, what am I missing?

Mars,

If I can hijack a sec. I changed all of my fluids a couple of weeks ago.
My 2006 Sporty takes about 3 quarts of oil to refill. My GF has an 07 sporty same engine etc. I don't know why but some reason hers never takes more than 2 1/2 quarts to fill.
I know it's not Sporty tech here but that's my strange oil change story .

I just experienced and learned the same thing a few weeks ago. Surprising since I've had the bike since 2002 and have around 80,000 miles on it.

My Duece had been sitting a while (couple months or so) so I checked the oil (cold) before taking it for a ride. It was low so I added a quart to bring it up to the "low" mark on the stick. When I returned from the ride it was way overfull.

The plug at the bottom of the case will only net you a few Oz of fluid and quiet a few have cracked there case removing it and installing it. Not worth the risk. It is a tapered pipe plug and suseptible to cracking the thin case. If you search it you will find a few horror story's from forum members.

Hmmm....the B motor oil pumps were designed with a wave washer and second spacer to prevent the oil tank from filling the sump. I wonder if the bikes that are sumping are high milers and that wave washer is losing tension?
