Oil level should be checked with the engine hot and within a couple of minutes of it being run. This is because harley engines have a seperate oil tank, it can be possible for oil to run from the oil tank into the engine sump when the bike has been parked for a while with the engine stopped which would give a false low level on the dipstick.
Your oil level is probably ok but to be sure warm the bike up and re-check - the really bad thing to do is top up the tank to full with the engine cold after the bike has been standing for a few days.

When you drain and refill it only takes 2 1/2 qts. Overfilling can cause oil to carryover into your air filter thru your breather tubes

K. My street bob with a 96 will drip oil out of the breather when the oil is up to the full hot mark. If I fill it to just a hair below full cold no oil drips.
And I am pretty sure you check the oil when bike is on the sidestand(I just can't say jiffy).
Now,I'm not saying yours will drip with the oil level up that high I am saying mine does. Running the bike a little low on oil doesn't harm it. It's a sumped system,which means there is a pick up in the reserve sucking the oil up and forcing it through the motor.
I am sure my drips are dues to the crankcase vent tube sucking up the sloshing oil when it's too full,but is there any harm,other than the drips,done by having the oil level a bit high.
