cant tell if its a bolt or screw-

R u talking about the bolt on the upper triple tree? if so is not just a pinch bolt that the upper tree itself is threaded on that side so the bolt should not go all the way through.

No need to panic, Fred!

This bolt is p/n 4352 and called: SCREW, 3/8-16 X 1-1/2 Torx (self-tapping) (Grade 8 steel).

The bolt used on my FXD2003 looks the same and is mounted in a similar way as shown in your image.
