Default Confusion about the solo rack

The description of the Rigid Solo Rack (P/N 52796-09) says you can "...attach the available Detachable Passenger Pillion (P/N 52689-09) for a comfortable two-up tour" yet it has a special product information "Note" that says,
"WARNING: Do not use this rack as a seat. Do not exceed the fender rack weight capacity. Using as a seat or exceeding this capacity could cause handling problems, which could result in loss of control and death or serious injury."
Then the instruction sheet for installing the rack says the maximum luggage rack weight capacity is 25 pounds.

Even if I ignore the warning note and use the OEM passenger pillion designed specifically to convert the rack into a seat, where the heck am I going to find a passenger that weighs less than 25 pounds? A case of beer weighs 20 pounds and it sounds like that's close to the limit.

Is this just some legal BS to appease some attorneys? Why would they say not to use it as a seat and then suggest you buy a seat for it? I assume that because they sell an optional seat for the rack that it can safely support an "average" passenger, right?

my guess is the pillion has additional support through the middle to allow the additional weight. so don't sit on the rack cause the rack center could buckle/bend with the additional weight on it.

I thought that applied to the detachable rack but not sure I'm sure that it is all legal issues.. I know they say more weight leads a better chance of less equal weight distribution so I would think it is just warnings for their legal department

That rack ain't gonna bend or break unless she's too big to be on the bike to begin with. I have the detachable rack and didn't buy it for a seat, I have a 2-up seat with detachable sissy bar for that. And I know it says the detachable solo won't support the pillion but I assumed that was more because of the cheap plastic parts used on the detachable points more than anything else.
