the e.p.a. requirements would be a federal requirement...plan and simple '09 californlia and '10 in the other states. what does it matter? prior to '10 the only state that required a converter was california. why are you wasting time worrying about this...only california requires a stamp on the exhaust that says it meets e.p.a. standards. several states do not even do an annual inspection. once again, this post has wandered completely off the original question...read all the posts...especially the first...if you feel the need to comment.

there were no catalytic converters on any harleys in '07 or '08...first year was '09 and then only in california. '10 was the first year they were required nationwide. only california is enforcing this law---vance & hines was fined several hundred thousand dollars for non-complying exhausts--many dealers in california will not install pipes that do not have the e.p.a. stamp. many exhaust makers cannot or will not spend the money to get their pipes approved. this will be a trend that many other states follow in the next few years. stock mufflers that meet e.p.a. standards will be the norm eventually. the only loud pipes will be on older bikes, or bikes that the owners have removed the baffles.

As stated above and also on page 29 of the 2009 owners manual:

All FXDF models are equipped with catalytic converters.
For all other Dyna models, only international, Japan, and California markets
include catalytic converters.

My 2009 had one in it. In the 2008 and 2009 Harley-Davidson Parts catalogs, the 2008 FXDF and the 2009 FXDF share the same part number for the head pipe, 64984-08 (updated to a 64984-08A). The 2010-2012 models take part number 64997-08A for the head pipe.
