In reply to 06dynablack the downloads do have a part number but they are a cartiridge that gets loaded into your ECM using the HD digital technician.
You cannot load it without it. If you get a SERT all the current downloads come on CD with the SERT and you can load them into your ECM and see how it runs.

Yes, the backing plate only covers the back of the filter, the sides are exposed. The football cover attaches to the filter with a single bolt through the center hole in the filter, leaving the back side of the cover open. Take the cover off and you see the entire filter. The Ness kit looks almost identical to the SE kit pictured below and the filters are interchangable. The K&N kit uses an oval shaped filter instead of the round one in the SE and Ness kits, but the principal is the same.

If you get a new air intake, I'd go with a SERT or PC III for fuel management. You wouldn't need the download. I certainly didn't. I just chose from the maps available and you can tweak it or get it dynoed.
Here's a couple covers I swap with my SE intake. There are a bunch more. I use a Drag Specialties reuseable filter. You can also use a K&N. They are the same size as the disposable SE that comes with the SE intake.

Before you spend your money, grab the June 2007 issue of American Rider and read the article on page 72. It is very enlightening. If your willing to spend the money on a SERT as well as the air cleaner then ok. You can tweak the AFR's as needed. Otherwise, it may not be worth the money just to throw on a different air cleaner. As the article states " In the important and more useful 1,500 to 4,000 rpm range, the stock air claener was clearly superior." Check it out.
