I inspect my brakes regularly and would change my brake pads well-before that event occurred.
But, let's imagine I ignore my brakes for many thousands of miles, and then those two thin pieces of brittle brake pad material did finally meet end-on-end under the enormous pressure applied by my caliper.
I'd guess they would crush together and break off harmlessly in small pieces over time, and would not interfere with braking function at all.
I understand your modification is minor and is probably safe, but, as a general rule modifying brake pads is not safe and I do not recommend it.
I also don't recommend my solution of using brake pads un-modified as a permanent solution to the 'incorrect bracket' issue. That said, it is a safe stop-gap measure.
What I recommend is getting the newly-released '06- Dyna bracket from Ness: Part # 02-972

I got the 02-972 bracket a week ago, directly from Ness. Apparently they've just made them. It fits my 2011 SB/49mm fork.
I bought the "all Dyna" kit early this year and, when it didn't fit, I contacted them and did a whole bunch of waiting for the correct bracket to be designed and manufactured.
I haven't seen it advertised anywhere, not even on Ness's website. You'd need to hit them up by phone or e-mail, or forum member/Sponsor Hogpro seems to have a line to get them from Ness.

do you have the updated bracket or will ness comp that? i think my kit has arrived at my house. i'll roll through the hood later and see if it is what was on the ups alert i got this morning about a tucker rockey shipment @ 6.10 lbs.

The rotor is going in for gloss powder on the center star tomorrow.
The bracket is labeled "02-965-1".... dated 11/20/2015
Is this the new hotness? Or is it the old wackness?
Edit: I reread the abov posts and according to them... I have the old wackness and it should be 02-972 for my 2013. is that right?

If your bracket is like mine, it has the numbers "02-972" machined into it. The old bracket didn't have any numbers machined into it, just the Ness logo.
