I would definitely speak to the shop manager and threaten a lawsuit....

I think the frames are powder coated, not painted, so there probably is no clear coat. It looks like that area is on the underside of your bike, why worry about it? You'll forget about it soon enough.

Now, if they scratched or dented your gas tank, that would be an issue.

I thought I was bad.

The easiest fix is to ride the bike a few hundred miles. It'll get covered in grime and bugs and you'll never have to worry about it again.
