My bike had around 2300 miles on it when it was under basic warrenty and I had a couple of months left and figured might as well do the big bore kit now for it will be out by Time (2 years) . if there is a time and milage clause, its a double edge sword and it is what it is.
Its time to upgrade!!

38000 miles four years? come on guys If no clear sign of low oil or no oil dealer should be going to bat for this guy. dmax don't give up, take pic's write and call hd yourself. find the right person at hd and you can get some help.
There is no way a dealer is going to go to bat for this, the warrranty has a set period and this is well beyond that. Kinda like saying my toaster is only used on weekends, and it died 5 years later, I want a new one.
Parts unfortunately do fail on their own sometimes, unfortunate but out of warranty means just that, they are not going to help with any of the costs.

I'm not expecting anything. It's a shame that 38000 is all I got from this engine. I had a six year old Buick years ago that the engine went at 58000 miles,no warrenty but the factory put a new motor in it for 1000.00 . the called it a catostrofic failure and had a one time policy of replacement with a 1000 dollar deductable.. It was kind of like here is a break for something that should not happen but did.. Worked for me ,too bad HD doesn't stand behind there product as well
HD DOES stand behind their product! For two years, unlimited mileage, after purchase. It's not HD's fault that you don't ride your bike too often or too far. You also had the opportunity to purchase an Extended Warranty which you failed to do. It's always in your best interest to protect yourself. Granted, it's a lousey deal to loose an engine at 38K miles but s**t happens. On the other side of the coin, I lost the cam chain tensioners at 50K miles, after 3 years, and it only cost me $100 to rebuild/repair the engine. All it takes is one failure and your Extended Warranty pays for itself.

Well, I hate it for you but it sounds like a good time to do some good mods. You will probably come out better finding a reputable shop that does this kind of work and do it cheaper than HD will.
I had 37,000 on my 2007 Road Glide and had bearing failure. There was a reason I bought the extended warranty!...I have $35,000 in that mororcycle and I was not going to take any chances! I had the flywheels re done and balance along with a complete engine rebuild. This would have cost me almost $6000 without the insurance. I paid $50.00. I have serviced my bike on a regular basis and have used only Harley Screaming Eagle Synthetic Oil. I hate to hear these kinds of stories...but man, you have to protect yourself! Regardless of who is to blame...Once you are out of factory warranty...all bets are off! I think you can still buy an extended warranty if your bike has less than 75K.
