If it does not start in gear with the clutch pulled in, the clutch safety switch in the left switch housing is not making connection.
Either you have a problem, or someone put chrome switch housings on and didn't do it right.
All H-Ds from 2007 on have a starter lock out safety switch which will prevent them from starting in gear unless the clutch is engaged. With the clutch engaged, it should start in gear the same as in neutral'
If it is in gear my 08 sometimes won't start with the cluch pulled in, sometimes it will. I usually have it in neutral so I haven't kept track of how frequent.
I plan on looking into it over the winter, been debating adding the chrome switch housings anyway.
why disable it? Fix it!
You may have just lost your proper position of the handelbar clamp and the switch housing. Worst case is the lil wedge in the switch housing isnt doing it's job pushing the switch hard enough against the housing. I wouldnt disable it. It would probably be more work to disable it than to fix it.

That sounds like a real nuisance if not a safety hazard on the road. If the engine stalls, you need to find neutral before refiring it? There have been times when the engine has stalled in slow going and all I had to do was pull in the clutch, restart and be on my way. I'd hate to be stalled on the road and get rear ended while fishing for neutral to get her refired.
